1. Scope
These General Terms and Conditions apply to all contractual relationships between Dominik Weber (hereinafter “Provider”) and the customers (hereinafter “Users”) who use FinalWill’s online services.
2. Subject of the contract
FinalWill offers users a software-as-a-service tool to manage and secure their digital estate. The service includes various packages and a free trial period.
3. Conclusion of contract
The contract is concluded when the user registers and agrees to these terms and conditions. The user can choose between different packages and initially receives a 30-day free trial period.
4. Provider services
The provider provides the user with the agreed services in accordance with the selected package. The detailed service descriptions and functionalities of each package can be found on the provider's website.
5. Obligations of the user
The user is obliged to provide true and complete information when registering and to keep his data up to date. The user is responsible for keeping his access data confidential.
6. Data protection
The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and the provider's specific data protection guidelines.
7. Prices and payment terms
The prices for the different packages and the payment methods are set out on the provider's website and during the registration process. All subscriptions are automatically extended for another year unless canceled in the customer account.
8. Termination
The subscription can be canceled at any time at the end of the contract term via the customer account. The trial period ends automatically without the need for cancellation if the user decides not to take out a paid subscription.
9. Warranty and liability
The provider is not liable for data loss or damage resulting from improper use of the services by the user. Liability in the event of intent or gross negligence remains unaffected.
10. Changes to the Terms and Conditions
Changes to these Terms and Conditions will be communicated to the user by email and will come into force 30 days after such notification. Continued use of the Service after the changes come into effect constitutes acceptance of the changed terms.
11. No substitute for a will
FinalWill is a platform for the administration of digital estates. It is important to understand that the use of FinalWill is not a substitute for the preparation of a legally valid will. We recommend that all users also draw up a legally valid will in order to regulate the distribution of their entire estate in accordance with the statutory provisions. FinalWill is intended to supplement the organization and management of digital assets, but not to replace the legal aspects of a will.
12. Final provisions
If parts of these terms and conditions are ineffective, the validity of the remaining provisions remains unaffected. German law applies. The exclusive place of jurisdiction is the registered office of the provider.
